ALLOCATION OF CRIMINAL AND ADMINISTRATIVE RESPONSIBILITY FOR ANTI-DOPING RULE VIOLATION

Abstract (English):
Introduction: the article describes the issue of allocation of responsibility for anti-doping rule violation in criminal legislation of the Russian Federation (the Federal Law No. 392 dated November, 22 2016 included Art. 230.1. and 230.2 of the Criminal Code of the Russian Federation) and Administrative legislation (Art. 6.18 Administrative Offenses Code of the Russian Federation). Materials and Methods: the International Convention against Doping in Sports6, the World Anti-Doping Code7, the Constitution of the Russian Federation8, the Criminal Code of the Russian Federation, the Code of Administrative Offences of the Russian Federation, the Labor Code of the Russian Federation, the rules of sports law1 and other normative legal acts related to the subject of the study. The methodological basis was the dialectical-materialistic method of cognition and the general scientific and private research methods based on it, such as analysis, synthesis, logical-legal, comparative-legal methods Results: the article gives a comparative description of the compositions of offenses provided for in Articles 230.1. and 230.2 of the Criminal Code of the Russian Federation and Article 6.18 of the Administrative Code of the Russian Federation, highlights their common and distinctive features, a proposal to amend the Administrative Code of the Russian Federation. Discussion and Conclusions: the conclusion about the challenges arising in the differentiation of the considered offenses in connection with the coincidence of their features was made, the proposal to exclude Art. 6.18 of the Administrative Code of the Russian Federation from Chapter 6 was made and justified.
